The paper is focused on identifying criteria for legal reasoning used by courts in disputes regarding internet intermediary‘s liability offences committed someone else. There are cases with this atypical phenomenon when a person, who did not infringe else‘s individual rights, held liable, e. g. of an platform‘s operator unlawful comments posted the visitors. presents analysis which carry potential to be future new related technological innovation reach courts.
